Terms & Conditions

Gratitude Weight Loss (“we”, or “us”) operates a mobile messaging program (the “Program”) subject to these Mobile Messaging Terms and Conditions (the “Mobile Messaging Terms”). The Program and our collection and use of your personal information are also subject to our Privacy Policy. By enrolling, signing up, or otherwise agreeing to participate in the Program, you accept and agree to these Mobile Messaging Terms and our Privacy Policy.

Program Description:

 

We may send promotional and transactional mobile messages in various formats through the Program. Promotional messages advertise and promote our products and services and may include promotions, specials, other marketing offers, and abandoned checkout reminder transactions and may include. Transactional messages relate to existing or ongoing order notifications and updates, appointment reminders. Mobile messages may be sent using an automated technology, including an auto dialer, automated system, or automatic telephone dialing system. Message frequency will vary but will not exceed 20 messages per month. You agree that we, our affiliates, and any third-party service providers may send you messages regarding the preceding topics or any topic and that such messages and/or calls may be made or placed using different telephone numbers or shortcodes. We do not charge for mobile messages sent through the Program but you are responsible for any message and data rates imposed by your mobile provider, as standard data and message rates may apply for SMS and MMS alerts.

User Opt-In:

 

By providing your mobile phone number to us, you are voluntarily opting into the Program and you agree to receive recurring mobile messages from us at the mobile phone number associated with your opt-in, even if such number is registered on any state or federal “Do Not Call” list. You agree that any mobile phone number you provide to us is another transaction-related information insert a link to your privacy policy valid mobile phone number of which you are the owner or authorized user. If you change your mobile phone number or are no longer the owner or authorized user of the mobile phone number, you agree to promptly notify us at (321) 334-3668 Your participation in the Program is not required to make any purchase from us and your participation in the Program is completely voluntary.

User Opt-Out and Support:

 

You may opt out of the Program at any time. If you wish to opt- out of the Program and stop receiving mobile messages from us, or you no longer agree to these Mobile Messaging Terms, reply STOP, QUIT, CANCEL, OPT-OUT, and/or UNSUBSCRIBE to any mobile message from us. You may continue to receive text messages for a short period while we process your request and you may receive a one-time opt-out confirmation message. You understand and agree that the foregoing is the only reasonable method of opting out. For support, reply HELP to any mobile message from us.

Our mobile messaging platform may not recognize requests that modify the foregoing commands, and you agree that we and our service providers will not be liable for failing to honor requests that do not comply with the requirements in these Mobile Messaging Terms. We may also change the telephone number or short code we use to operate the Program and we will notify you of any such change. You acknowledge that any requests sent to a telephone number or short code that has been changed may not be received by us and we will not be responsible for failing to honor a request sent to a telephone number or short code that has been changed.

 

Disclaimer of Warranty and Liability:

 

The Program is offered on an “as-is” basis and may not be available in all areas, at all times, or on all mobile providers. You agree that neither we nor our service providers will be liable for any failed, delayed, or misdirected delivery of any mobile message or information sent through the Program.

Modifications:

 

We may modify or cancel the Program or any of its features at any time, with or without notice. To the extent permitted by applicable law, we may also modify these Mobile Messaging Terms at any time. Any such modification will take effect when it is posted to our website. You agree to review these Mobile Messaging Terms periodically to ensure that you are aware of any modifications. Your continued participation in the Program will constitute your acceptance of those modifications.

Financial Agreement:

Your bank statement may say Gratitude WL instead of Gratitude Weight Loss.

WHEREAS, Patient is in need of and desires alternative health care treatment; and WHEREAS, Office is in the practice of providing health care and desires to provide care to Patient; and WHEREAS, Patient desires to receive health care from Office; 

NOW, THEREFORE, in consideration of the mutual agreements between the parties as set forth herein and for other good and valuable consideration, the parties hereto agree as follows:

PATIENT COOPERATION 

This Agreement assumes full patient cooperation. This cooperation includes the Patient's agreement to remain active in the recommended treatment program. Failure to do so may result in an incomplete treatment program. Hence, compliance to recommended schedules is equally important and Patient agrees to keep appointments. The patient understands that additional treatments may be necessary due to lack of cooperation, failure to keep appointments, failure to follow Office recommendations, engaging in activities outlined to be injurious or which may cause additional trauma to the body. Additional treatments due to Patient’s lack of cooperation as outlined above would be in addition to treatments provided by this agreement. The Patient understands that all treatments shown in this agreement must be used within one (1) year of purchase. Any treatments not used within one (1) year of purchase are expired and no longer available to the Patient. 

Gratitude Weight Loss REQUIRES A MINIMUM 24 HOUR NOTICE TO CANCEL OR RESCHEDULE TREATMENT. YOU WILL BE CHARGED FOR ANY MISSED, RESCHEDULED OR CANCELED APPOINTMENTS, UNLESS WE ARE NOTIFIED AT LEAST 24 HOURS IN ADVANCE

REFUNDS

Client authorizes Gratitude Weight Loss (“Office”) to charge their credit card or other form or forms of payment for non-refundable purchases. Purchases made with third party financing companies are non-refundable. Regardless of the form of payment, I understand this is a non-refundable purchase. Any pre-paid treatments over 12 months from date of purchase are considered expired and are no longer valid. There will be no refund for expired treatments.

SUBSEQUENT INJURIES 

If Patient suffers a new injury, the office will not be responsible for any loss that results from such injury. The Patient retains the right to purchase additional services from the Office.

NO GUARANTEE OF RESULTS 

Patient recognizes that this agreement is not a guarantee of results. Patient fully understands that this is a non-refundable purchase and this payment service is not intended to treat any disease. Patent has had the opportunity to ask questions regarding the nature and scope of treatment and the associated costs to receive such treatment.

Diagnostic testing may be covered by your health insurance company. We will check what benefits you have. This will save you out of pocket expenses to see what metabolic deficiencies, allergies, and or genetic defects you may have or be predisposed to. We will not charge you without your consent for testing if your insurance does not cover these tests. We will present you with the options you are approved for with no out of pocket expense to enhance your weight loss journey. Please provide your insurance details below

COMPLETE AGREEMENT

Patient attests that all of the answers above are true. I understand that Gratitude Weight Loss Inc and its host location(s) do not guarantee results and therefore shall not be responsible for unfavorable results especially if I have withheld or misrepresented the information that I provided above.
